The first round of Samsung Galaxy Note7 lawsuits have begun

The first round of Samsung Galaxy Note7 lawsuits have begun and they’re not what you would have expected. Given that the Note7 exploded and caused burns and property damage, you would think to see personal/property damage lawsuits. Instead, three people have filed lawsuits against Samsung for the time they lost having to wait for Samsung to fix the problems. That’s right, these lawsuits are asking Samsung to pay the plaintiffs for time they couldn’t use their phones.

Now before we call this one absurd just hear out the basis for this complaint and maybe you could sympathize. The lawsuits are asking for Samsung to pay for that time due to the carrier charges users faced while having a phone they could not “safely use.” In other words, these plaintiffs are asking to be compensated their wireless bill charges because they didn’t have a device that could use the plan they were paying for.

Interestingly the lawsuit does not refer to the bill credits and the option of a refund, which was introduced under a recall announced by the U.S. Consumer Product Safety Commission on Sept. 15. The consumers discontinued using their Note7s only to find that Samsung did not have replacement smartphones available, according to the complaint filed in the U.S. District Court for the District of New Jersey, Newark division by users John Waudby, Robert Spuntak and Mohamad Ibrahim.

The complaint, which seeks an unspecified damages award from the court, charges that Samsung made “material misstatements and omissions” about the availability of replacement Note7s, and as a result the three plaintiffs and class members “were fraudulently induced to continue incurring and paying monthly charges and fees for their Note7s, which they could neither use nor replace.” Samsung did not immediately comment on the lawsuit.
