Lawsuit asserts 42 Disney apps tracked children without parents consent

A lawsuit brought forth by San Francisco resident Amanda Rushing claims that 42 Disney apps are tracking kids without consent. The lawsuit claims Disney is violating the Children’s Online Privacy Protection Act in the collection and sale of the children’s data. Among the 42 Disney apps cited in the complaint are, Beauty and the Beast, Frozen Free Fall, and Toy Story: Story Theater. Rushing says Disney has included software inside these apps that can track users across devices and platforms giving the company a full profile of the user.

Rushing wants Disney to immediately stop its tracking practices (without consent) and stop sharing data to third-party buyers. The lawsuit also says Disney should destroy any information it has collected thus far and also pay damages and legal fees.

Disney, however, has said it’s “looking forward” to defending itself. “Disney has a robust COPPA compliance program, and we maintain strict data collection and use policies for Disney apps created for children and families,” it told the Business Journals.

“The complaint is based on a fundamental misunderstanding of COPPA principles, and we look forward to defending this action in Court.”

This should be an interesting case as laws are so wrapped up in legalese the case could go either way depending on how it’s argued before the judge.
